A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to answer human smuggling charges, he was held in federal detention.

In her decision, the judge noted that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
